Request Deferred Disposition
You may request Deferred Disposition (PDF) in person or by mail within thirty (30) days of the date your citation was issued. You must contact the Court for instructions on completing the deferred form and to obtain your deferral fee. Upon receipt of the application and any administrative fees, your request will be forwarded to the Judge. If the Judge grants your request, you will be placed on probation for not more than one hundred eighty (180) days, during which you must not receive any citations in the Town of Pantego. 

You are not eligible for Deferred Disposition if:

  • You do not have a valid driver’s license; or
  • Your license is suspended; or
  • You have a commercial driver’s license (CDL); or
  • You received your ticket in a construction or maintenance work zone when workers are present; or
  • You have warrants, past due fines, or charges to which you have not responded in the Town of Pantego; or
  • You have been approved for Deferred Disposition in the Town of Pantego within the last six (6) months; or
  • You were speeding twenty-five (25) or more miles per hour or more over the speed limit; or
  • You were speeding sixteen (16) miles per hour or more over the speed limit in a school zone; or
  • You received a ticket for not having current liability insurance and you were involved in an accident; or
  • You received a ticket for not having current vehicle liability insurance and you do not provide a copy of your current vehicle liability insurance.

If you are under 25 years of age, you may be eligible for deferred disposition only if you take a Driving Safety Course after entering a plea.


Dismissal After Probation
At the end of the deferral period, provided you have met all the conditions of your probation, the Judge will dismiss your citation. Dismissal of your citation will not affect your auto insurance rates or coverage and will not be reported to the Department of Public Safety (DPS).

Failure to Comply 
If you fail to comply with any one of the terms or conditions of your probation, the court will schedule a hearing to discuss your case with the Judge. If you do not appear at this hearing, a final judgment of "guilty" will be entered and a capias pro fine warrant for your arrest may be issued. The "guilty" conviction will be reported to the Department of Public Safety (DPS) and will appear on your driving and/or criminal record.


GENERAL INFORMATION

  • Our office is open on weekdays, excluding holidays, from 8:30 a.m. to 12:00 noon and from 1:oo to 5:00 p.m. (We are closed daily for lunch from 12:00 to 1:00 p.m.)
  • All official correspondence must be mailed via the United States Postal Service (USPS) or delivered in person.
  • If the Court is closed due to weather conditions or a Town holiday, your due date will move to the next business day that our offices are open.
